
Diversion
Diversion is available only in certain cases and charges in Ohio. If the court allows you to enter Diversion, you will be placed on a term of probation with the opportunity to show the court you can successfully complete all their requirements. Upon completion of the Diversion program, the court will dismiss the case and you are left without a conviction. However, it requires you to completely admit you are guilty and you waive your right to have a trial or present any defense. In exchange, the State will promise to not send you to jail and to keep the charge off your record. This is contingent upon you completing your term of probation and not committing any new offenses. Diversion is typically only available for first time offenders and only in certain types of cases, such as nonviolent charges.
