In Ohio, an OVI is one of the few crimes that has mandatory jail time. This means that even if the judge on your case does not want to send you to jail, Ohio law mandates it and the judge has no choice.
An OVI is also an enhanced offense, meaning every time a person is convicted of an OVI the penalties increase. For example, a first-offense OVI requires three days in jail while a second offense within the last six years requires ten days in jail, and in some cases twenty days. The number of days in jail increases for each OVI conviction.
